These Terms and Conditions ("Terms") govern your use of our services and website. By engaging with Enhance Physique, you agree to be bound by these Terms.

2. Definitions

• "Services" means all fitness training, coaching, wellness programs, and related services provided by Enhance Physique
• "Client" or "you" means the individual or organisation purchasing our Services
• "Agreement" means the contract formed between you and Enhance Physique upon booking
• "Trainer" means qualified fitness professionals employed or contracted by Enhance Physique

3. Service Provision

3.1 Booking and Acceptance

• All bookings are subject to availability and acceptance by Enhance Physique
• A contract is formed when we confirm your booking in writing (email confirmation)
• We reserve the right to refuse service at our discretion

3.2 Age Requirements

• Clients must be 18 years or older to purchase services independently
• Clients aged 16-17 require parental/guardian consent and supervision
• Services for clients under 16 must be arranged with parental/guardian involvement

4. Medical and Health Considerations

4.1 Health Disclosure

You must complete a Pre-Activity Readiness Questionnaire (PAR-Q) and disclose all relevant medical conditions, injuries, medications, and health concerns. Failure to disclose information may result in termination of services without refund.

4.2 Medical Clearance

We may require written medical clearance from your GP or healthcare provider before commencing certain programs. This is at our discretion and in your best interest.

4.3 Assumption of Risk

You acknowledge that participation in physical exercise involves inherent risks, including but not limited to muscle strains, sprains, cardiovascular events, and other injuries. You assume all such risks voluntarily.

4.4 Not Medical Advice

Our services do not constitute medical advice. Always consult qualified healthcare professionals for medical concerns.

5. Pricing and Payment

5.1 Pricing

• All prices are in British Pounds Sterling (GBP) and include VAT where applicable
• Prices are subject to change with 30 days' notice for recurring subscriptions
• Corporate pricing is subject to individual quotation

5.2 Payment Terms

• Payment is due in advance unless otherwise agreed in writing
• We accept payment by credit/debit card, bank transfer, or other approved methods
• Monthly subscriptions are billed on the same day each month
• Annual memberships are payable in full upfront unless payment plan arranged

5.3 Late Payment

• Late payments may result in suspension of services
• We reserve the right to charge interest on overdue amounts at 8% above Bank of England base rate (per Late Payment of Commercial Debts (Interest) Act 1998)

5.4 Refunds

• Refunds are subject to our Cancellation and Refund Policy (Section 6)
• Processing fees are non-refundable
• Refunds will be issued to the original payment method within 14 days

6. Cancellation and Refund Policy

6.1 Cooling-Off Period (Consumer Contracts Regulations 2013)

If you are a consumer, you have the right to cancel within 14 days of purchase without giving any reason. If services have already commenced with your consent, you will be charged a pro-rata amount for services provided.

6.2 Cancellation by Client

• Individual Sessions: 24 hours' notice required, or session is forfeit
• Monthly Subscriptions: 30 days' notice required
• 12-Week Programs: Refunds available within first 7 days only (minus sessions used)
• Annual Memberships: No refunds after cooling-off period, but may be suspended for medical reasons with documentation
• Retreats/Bootcamps: See specific terms provided at booking

6.3 Cancellation by Enhance Physique

We reserve the right to cancel services with reasonable notice. In such cases, you will receive a full refund for unused services.

7. Client Responsibilities

As a client, you agree to:

• Arrive punctually for scheduled sessions
• Wear appropriate fitness attire and footwear
• Follow trainer instructions and safety guidelines
• Maintain personal hygiene standards
• Respect other clients, trainers, and facility rules
• Not attend if you have contagious illness
• Report any injuries or health changes immediately

8. Facility Rules

• No alcohol, illegal drugs, or smoking on premises
• No abusive, threatening, or inappropriate behaviour
• Respect equipment and facilities
• Follow health and safety protocols
• Maintain confidentiality regarding other clients

9. Liability and Insurance

9.1 Our Liability

We maintain appropriate public liability insurance. Our liability is limited as follows:

• We do not exclude liability for death or personal injury caused by our negligence
• We do not exclude liability for fraud or fraudulent misrepresentation
• Subject to the above, our maximum liability is limited to the total fees paid by you in the preceding 12 months

9.2 Your Liability

You are responsible for any damage to our equipment or facilities caused by your negligence or wilful misconduct.

10. Intellectual Property

All content, training programs, materials, branding, and intellectual property remain the property of Enhance Physique Ltd. You may not reproduce, distribute, or commercially exploit any materials without written permission.

11. Data Protection

We process your personal data in accordance with UK GDPR and Data Protection Act 2018. See our Privacy Policy for full details.

12. Complaints Procedure

If you have a complaint:

1. Contact us at complaints@enhancephysique.com within 7 days of the issue
2. We will acknowledge your complaint within 3 working days
3. We will investigate and provide a response within 14 working days
4. If unresolved, you may escalate to Alternative Dispute Resolution (ADR) services

13. Suspension and Termination

We reserve the right to suspend or terminate services immediately if:

• You breach these Terms
• You engage in abusive, threatening, or inappropriate behaviour
• You fail to pay amounts due
• You provide false health information
• Your behaviour poses risk to yourself, trainers, or others

No refund will be provided for termination due to breach of Terms.

14. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, strikes, or facility closures.

15. Photography and Marketing

We may take photographs or videos during sessions for training purposes or marketing. We will obtain your explicit consent before using any images containing your likeness for marketing purposes. You may withdraw consent at any time.

16. Corporate Services

Corporate Wellness programs are subject to separate agreements. These Terms apply unless specifically varied in writing.

17. Online Coaching

For online coaching services:

• You are responsible for ensuring appropriate space and equipment
• Stable internet connection is required
• Video sessions may be recorded for quality and safety purposes (with consent)
• We are not liable for technical issues outside our control

18. Amendments to Terms

We may amend these Terms from time to time. Material changes will be notified by email or website notice at least 30 days in advance. Continued use of services constitutes acceptance of amended Terms.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any specific program terms, constitute the entire agreement between you and Enhance Physique.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
